Delay caused by Indo Nippon Chemical Co Ltd case increased cost by Rs 80 lakh and 29 months and delay caused by Shree Yashwant Society case increased cost by Rs 1.2 crore and 46 months.

The Bombay High Court has quashed a Public Interest Litigation (PIL) that challenged the NOC granted by aviation authority with respect to restrictions regarding height near Juhu airport. With this ruling, MMRDA can successfully move on with construction of the Mumbai Metro line 2B between DN Nagar and Mandale.

Additionally, Bombay High Court also ruled in favour of MMRDA against the writ petitions filed by Indo Nippon Chemical Co Ltd. in 2018 and Shree Yashwant Co-operative Housing Society Ltd in 2019, regarding the Mumbai Metro 4’s alignment, that in addition to affecting their respective properties, the execution of metro was in violation of statutory provisions, including the land acquisition carried out under the MRTP Act, 1966. Under the Writ petition, Indo Nippon Chemical Company Limited demanded a compensation of sum of Rs 301 crore.

As per the statement issued by MMRDA, delay caused by Indo Nippon Chemical Co Ltd case increased cost by Rs 80 lakh and 29 months and delay caused by Shree Yashwant Society case increased cost by Rs 1.2 crore and 46 months.

“Infrastructure projects like Metro lines that MMRDA undertakes are for greater public benefits and they should not be embroiled in such legal battles which lead to delay in project delivery and cost to the exchequer. We are thankful that the high court has ruled the case in our favour and quashed the PIL on merit,” said SVR Srinivas, commissioner, MMRDA.
