MahaRERA’s 10 Benches to Start work from January 1

These benches will try to resolve the dispute and if it is not resolved, it will go to MahaRERA for regular hearing.


Mumbai: The Maharashtra Real Estate Regulatory Authority (RERA)'s MahaRERA conciliation benches will be set up soon and be fully functional from Jan 1, 2018. MahaRERA is planning to establish 10 benches for Mumbai Metropolitan Region (MMR) and Pune, which will work on the compromise formula after filing a case before MahaRERA, sources told to The Asian Age.


MahaRERA is overburdened due to increase in the number of cases. Initially, notices were issued to builders and explanation sought regarding the complaints of the homebuyers. But this is a time-consuming process and often the builder pays heed to the complaint after MahaRERA's intervention.


“In order to reduce the time and burden on MahaRERA, these conciliation benches will be set up as per provision in the act,” sources said.


Two members will be appointed over the 10 benches that will be in Pune and Mumbai. For Mumbai, one representative will be from the National Real Estate Development Council or Maharashtra Chamber of Housing Industry and one representative of Mumbai grahak panchayat. For Pune, there will be one representative from Confederation of Real Estate Developers Association of India and other one will be the representative of the Mumbai grahak panchayat.


These benches will hear the matters if the complainant is ready to compromise or if the matter comes after filing.


These benches will try to resolve the dispute and if it is not resolved, it will go to MahaRERA for regular hearing. If the dispute gets resolved before the bench, then both the parties will file consent terms before MahaRERA.


So these benches will work as an alternative dispute resolution system.
